Responding To The 50 Shades of Grey In Black and White: Avoiding and Defending Discrimination and Harassment Lawsuits - Employers are charged with providing employees with a work environment that is free of discrimination and harassment. Management acts as both the eyes and ears of the organization charged with identifying and responding to discrimination and harassment on the organization’s behalf. With the varying shades of grey that inappropriate conduct may come in, how does management provide a black and white response? Attendees review employment laws standards (Title VII, ADA, ADEA) and, using recent cases test their abilities to recognize discrimination and harassment, discuss best practices for responding to internal complaints and posturing the organization to defend against suits.
Diversity and Inclusion: Management Strategies - Too often, diversity guidance consists of artfully crafted truisms that are neither insightful nor useful. However, if approached thoughtfully and deliberately, companies can use diversity management to fulfill compliance-related goals and improve bottom-line results. This presentation will provide insights as to how employers can structure their diversity efforts to maximize organizational results.
Mental Illness, Intellectual Disabilities and the ADA - With the dramatic expansion of the American with Disabilities Act (ADA) by the ADA Amendment Act of 2008 (ADAAA) and the EEOC's ADAAA final regulations effective as of May 24, 2011, ADA claims are skyrocketing. A great many of the burgeoning claims concern matters formerly called mental disabilities and which are now called intellectual disabilities. This presentation will provide the tools for employers to successfully navigate the maze posed by the interactive process and determine if a reasonable accommodation exists or whether the employer is confronted by an undue hardship or direct threat.
How to Carry out an FLSA Audit on Your Workforce - Compliance with state and federal wage-and-hour laws can be very challenging. In addition to minimum wage and overtimes issues, employers are constantly faced with decisions involving “exempt vs. non-exempt” status, “independent contractor vs. employee” classification, and a multitude of wage payment issues. One mistake, no matter how small, can lead to exposure to an investigation and/or a class action, expensive legal fees, and bad publicity for your company. In this briefing, we will address the “hot” wage and hour issues, and provide valuable insights and practical advice on how to avoid being a target of the wage-and-hour class action epidemic, including how to conduct an internal FLSA audit.
An Employer’s Guide to Navigating Healthcare Reform - On June 28, 2012, the United States Supreme Court upheld the Patient Protection and Affordable Care Act (PPACA), commonly referred to as Obama Care. PPACA has significant employment law ramifications for employers, particularly those with over 50 full-time employees or full-time equivalents. This presentation will highlight some of the key requirements and pitfalls of the legislation so that employers do not unwittingly run afoul of the law.
Election 2012: What Will It Mean for Employers? This panel discussion will examine how November’s elections could alter the legal and regulatory landscape employers will have to navigate in 2013 and beyond.
