Under both the Americans With Disabilities Act and the Georgia Workers' Compensation Act, employers may be liable for terminating injured/disabled workers because of their injury/disability. That is to say, an injured worker is automatically entitled to indemnity benefits if he is terminated because of his injury or disability. Likewise, a disabled worker may successfully sue an employer for violation of the ADA if the employer failed to make reasonable accommodations to enable the worker to perform the essential functions of the job.

In this lunch and learn, attorneys practicing in the areas of workers’ compensation and employment discrimination law will discuss best practices for limiting exposure when terminating injured/disabled employees.

Crystal Stevens McElrath is an attorney at Swift, Currie, McGhee & Hiers. Ms. McElrath represents employers, insurers, self-insureds, and third-party administrators in workers’ compensation, subrogation and employment law matters across Georgia. She frequently enjoys writing and presenting on a variety of topics related to workers’ compensation defense strategies.

Anandhi S. Rajan is an attorney at Swift, Currie, McGhee & Hiers. She practices general civil tort litigation with an emphasis on employment litigation, civil rights litigation, product liability and general liability cases. Ms. Rajan previously practiced for five years at another Atlanta law firm.
