The Department of Labor is in the process of changing the rules on what it takes to be exempt under the “white collar” exemptions of the Fair Labor Standards Act (passed in the late 1930s). The proposed changes are expected to have the greatest impact on small to mid-size companies, but employers of all sizes will be impacted.

John E. Thompson - Partner, Fisher & Phillips

John Thompson is a partner in the Atlanta office. His practice focuses on wage and hour law, emphasizing issues relating to minimum wage, overtime, timekeeping and wage-payment requirements.

Thompson assists employers in preventive efforts designed to ensure compliance, and he handles both investigations conducted by government agencies and litigation in the wage and hour area.

He has also addressed wage-hour topics in presentations to numerous employer groups and in articles appearing in both human resources publications and industry journals.

Ted Boehm - Of Counsel, Fisher & Phillips

Ted Boehm is Of Counsel in the Atlanta office. He represents management in all aspects of labor and employment law in state and federal courts as well as before state and federal agencies, including the Department of Labor and the Equal Employment Opportunity Commission. A significant portion of Boehm practice focuses on the defense of wage and hour claims arising under the Fair Labor Standards Act (“FLSA”). He also represents employers in discrimination and harassment claims arising under Title VII. Additionally, Boehm counsels clients on a wide range of day-to-day employment issues, providing practical and proactive advice to clients aimed at minimizing the risk of litigation and improving employee relations.
